1. Who you're contracting with

Nirvaaq ("we", "us", "our") is operated by Jay Pipalia. By accessing or using the Nirvaaq service at nirvaaq.com (the "Service"), you ("you", "user") agree to these Terms of Service. If you do not agree, do not use the Service.

2. Acceptance

By creating an account, accessing, or continuing to use the Service, you confirm that you accept these Terms and have the authority to bind the organization you represent (if applicable), or are of legal age to enter into a binding contract.

3. The Service

Nirvaaq is a B2B SaaS platform for verifying the freshness of produce through AI-assisted checks. We grant you a limited, non-exclusive, non-transferable right to use the Service within the limits of your selected plan.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • Use the Service for any unlawful, fraudulent, or abusive purpose;
  • Send spam, malware, or attempt to compromise the security of the Service;
  • Probe, scan, scrape, or test the vulnerability of the Service without authorization;
  • Infringe the intellectual property or privacy rights of others;
  • Reverse engineer, resell, or redistribute the Service or circumvent its technical limits.

5. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date.

6. Intellectual property

We retain all right, title, and interest in the Service, including its software, models, documentation, and branding. Nothing in these Terms transfers ownership of our intellectual property to you.

7. Service availability

We strive to keep the Service running smoothly but do not guarantee uninterrupted or error-free operation. Outages, maintenance, and third-party failures may occur.

8. AI outputs

Nirvaaq uses AI to assist with freshness assessments. Outputs may be inaccurate or incomplete and are not a substitute for human inspection or professional advice. You are responsible for verifying outputs before acting on them and for ensuring you have the rights to any inputs you submit.

9. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms.

Subscriptions renew automatically at the end of each billing period unless canceled. See our Refund Policy for refund details.

10. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends immediately.

11. Disclaimers and liability

To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill.

12. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
